May I ask Your Excellency to move the Right Honourable the Secretary of State for directions with regard to the disposal of fees in the Colonial Court of Admiralty.
The Colonial Court of Admiralty Act 1890, which substituted Colonial Courts of Admiralty for Vice Admiralty Courts, came into force in Hong Kong on the 1st of July 1891.
The Act provides (Section 7) that Rules of Court for regulating the procedure and practice of the Colonial Court of Admiralty may, subject to the approval of Her Majesty in Council, be made by the same authority as Rules touching the practice &c. of the Court in the exercise of its ordinary civil jurisdiction are made, and (Section 10 subsection 3) that if on the commencement of the Act in any British possession no new rules have been approved by Her Majesty the Rules in use in the Vice Admiralty Court at the time the Act commenced shall have effect in the Colonial Court of Admiralty as Rules under the Act. Then follow the words “and all fees payable under such Rules may be taken in such manner as the Colonial Court may direct so however that the amount of each such fee shall so nearly as practicable be paid to the same officer or person who but for the passing of this Act would have been entitled to receive the same in respect
